The present general terms and conditions of sale apply, without restriction or reservation to any purchase of the following services:
- Soul reading
- Mediumship reading : communication with the deceased love ones
as offered by the Seller to customers ("the customers or the customer") on the website http://www.maniphomsouvanh.com.
The customer declares that he/she is of legal age and not subject to a measure of protection for adults, and that he/she is not in a state of weakness or recognized psychological fragility
The main functions of the Services are presented on the website http://www.maniphomsouvanh.com.
The Service Provider Mani Phomsouvanh EI reserves the right to modify these conditions at any time by publishing a new version on its website.
The choice and purchase of a Service is the sole responsibility of the Customer.
These terms and conditions are accessible at any time on the site http://www.maniphomsouvanh.com and will prevail over any other document.
The Customer declares that he/she has read these terms and conditions and has accepted them by ticking the box provided for this purpose before placing an order online on the website https://calendly.com/online_booking.
The data recorded in the IT system of the Calendly Third Party Service Provider constitutes the proof of all transactions concluded with the Customer.

ARTICLE 2: PRICE
The Services are provided at the current rates appearing on the Service Provider's website http://www.maniphomsouvanh.com and on the Third Party Provider website https://calendly.com/online_booking .
The prices are in euros (VAT not applicable, art 293B of the general tax code)
The Service Provider Mani Phomsouvanh EI reserves the right to modify the prices at any time.
An invoice will be established by the Service Provider Mani Phomsouvanh EI and given to the Customer when the Services ordered are provided.
ARTICLE 3: ORDERS
It is the responsibility of the Customer to select on the website http://www.maniphomsouvanh.com the Services he/she wishes to order, according to the following procedures:
- On the website http://www.maniphomsouvanh.com, select the "My Services" section, then go to "Soul reading" or "Mediumship reading" according to your choice. You will find a description and the price mentioned on these two services.
- To book your session, go to the bottom of the page and click on the "Book a reading" button,
- You will be redirected to Calendly's reservation and payment platform (Third Party Provider) on this website https://calendly.com/online_booking ,
- Select the session you want (30 minutes or one hour session),
- Select the date and time you want from the calendar according to availability,
- Confirm your reservation by clicking on "Confirm",
- Fill in your personal details requested in the form,
- Choose the session you want ( soul reading or mediumship reading),
- Check the box to confirm that you have read and accepted the terms and conditions of sale.
- The secure payment method is made by Credit Card,
- Fill in your payment card information,
- To finalize your reservation and your payment, click on "Schedule Event ".
- You will receive an email confirming your order at the email address you provided when you placed your order.
The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to immediately notify the Service Provider Mani Phomsouvanh EI of any error.
Any order placed on the https://calendly.com/online_booking website establishes a contract between the Customer, the Service Provider Mani Phomsouvanh EI and the third-party service provider Calendly.
The Service Provider Mani Phomsouvanh EI reserves the right to cancel or refuse any order from a Customer with whom there is a conflict relating to the payment of a previous order.
ARTICLE 4: TERMS OF PAYMENT
The price is paid by secure payment, according to the following terms:
- payment by credit card.
The price is payable in full by the Customer on the day the order is placed.
Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider Stripe for banking transactions on the website https://calendly.com/online_booking .
Payments made by the Customer will only be considered as final once the sums due have been effectively collected by the Third Parties Calendly and Stripe.
The Third Party Provider Calendly will not be obliged to provide the services ordered by the Customer if the Customer does not pay the price in full in accordance with the conditions indicated above.
ARTICLE 5: PROVISION OF SERVICES
The Services ordered by the Client will be provided as follows:
- Soul reading online by video call on the Zoom platform
- Mediumship reading online by video call on the Zoom platform
After confirming the reservation, the Client receives a confirmation email sent by the Third Party Provider Calendly. This email will contain a summary of the order, as well as the Zoom link for the online appointment.
The customer shall ensure that he/she has a good internet connection on his/her computer, tablet or smartphone and access to Zoom.
5.1 Confidentiality
All information communicated in the context of the online session via Zoom, whether oral or written, will remain confidential.
The Service Provider Mani Phomsouvanh EI and the client agree to not make the content of the reading/consultation public in any form whatsoever. No personal information can and will not be transferred to a third party or used for purposes not agreed with the client.
The Service Provider Mani Phomsouvanh EI authorizes the audio or video recording of the reading/consultation by the Client but is not responsible for the proper functioning of the recording. The recordings remain strictly confidential and must not be used for public broadcast without the agreement of the Service Provider Mani Phomsouvanh EI and the Client.
ARTICLE 6: GUARANTEES
Mediumship and soul reading being divination arts, and considering the fact that the Service Provider Mani Phomsouvanh EI can in any case guarantee the realization of the predictions, and the free will of each individual, the Service Provider Mani Phomsouvanh EI cannot be held responsible, in case of non realization of these predictions as well as the actions committed by the customer.
ARTICLE 7: CANCELLATION AND REFUND POLICY
Readings/Consultations once booked are non-refundable . However, the client has the possibility to reschedule the appointment by contacting the Service Provider Mani Phomsouvanh EI by email at the following address: mani.mediumspirit@gmail.com until 24 hours before the initial appointment date. After this time it will not be possible to reschedule an appointment.
If the Service Provider Mani Phomsouvanh EI is unable to provide the Services booked by the Client, the Service Provider Mani Phomsouvanh EI will contact the Client by email and will propose another appointment date.
ARTICLE 8: RIGHT TO WITHDRAWAL
Given the nature of the Services provided, orders placed by the Customer do not benefit from the right of withdrawal.
This exclusion from the application of the right of withdrawal is expressly accepted by the Customer in application of the provisions of article L121-21-8. of the Consumer Code, which stipulates in particular that the right of withdrawal cannot be exercised for contracts for the supply of services whose execution has begun, with the consent of the consumer, before the end of the withdrawal period, which is expressly the case for the Service (s) covered by these terms and conditions.
The contract is therefore definitively concluded upon placing the order by the Customer in accordance with the terms specified in these Terms and Conditions.
ARTICLE 9: DATA PERSONAL
The Customer is informed that the collection of his personal data is necessary for the sale of the Services, their realization, and their delivery, as well as their transmission to third parties involved in the realization of the Services. These personal data are collected only for the execution of the contract for the provision of services.
9.1 Collection of personal data
Personal data that is collected on the site https://calendly.com/online_booking are as follows:
civility, first name, name, address, zip code, city, country, phone, email.
9.2 Recipients of personal data
Personal data is used by the Service Provider Mani Phomsouvanh EI and the Third Party Service Provider Calendly for the execution of the contract and to ensure the efficiency of services, its realization and its delivery.
9.3 Data controller
The data controller is the Third Party Service Provider Calendly, within the meaning of the French Data Protection Act and as of May 25, 2018 of Regulation 2016/679 on the protection of personal data.
9.4 Limitation of processing
Unless the customer expressly agrees, his or her personal data will not be used for advertising or marketing purposes.
In compliance with articles 39 and 40 of the law of 6 January 1978, the customer has the right to access, rectify, delete and oppose his personal data. The customer can exercise this right by writing an e-mail to the Service Provider Mani Phomsouvanh EI at this address: mani.mediumspirit@gmail.com.
ARTICLE 10: INTELLECTUAL PROPERTY
The content of the site http://www.maniphomsouvanh.com is the property of the Service Provider Mani Phomsouvanh EI and is protected by the French and international laws relating to intellectual property.
Without prior authorization, any partial or total reproduction of the site http://www.maniphomsouvanh.com is strictly forbidden and is likely to constitute an infringement of copyright.
ARTICLE 11: APPLICABLE LAW - LANGUAGE
These terms and conditions, and the transactions resulting from them are governed and subject to French law.
These Terms and conditions are originally written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail and the French courts shall have exclusive jurisdiction in the event of a legal dispute.
